These Terms of Service (“Terms”) govern your access to and use of Crema Manager (the “Service”), operated by SP Hospitality Group on behalf of Crema Gourmet (“we”, “us”, or “our”). By accessing or using the Service, you agree to these Terms.
1. The Service
Crema Manager is an internal business platform that helps authorized Crema Gourmet staff and franchisees manage stores, customers, reviews, and related operations. The Service is provided for legitimate business use by authorized users only.
2. Accounts and eligibility
Access requires an account provisioned by Crema Gourmet. You are responsible for keeping your credentials confidential and for all activity under your account. You must be authorized by Crema Gourmet to use the Service and must be of legal age to enter into these Terms.
3. Acceptable use
You agree not to:
- use the Service for any unlawful or unauthorized purpose;
- access data you are not authorized to access, or share access with unauthorized persons;
- interfere with, disrupt, or attempt to gain unauthorized access to the Service or its systems; or
- use customer or business data in violation of applicable law or of the policies of Crema Gourmet and connected platforms.
4. Your content and data
Content and data you submit or import remain the property of Crema Gourmet and its franchisees, as applicable. You are responsible for ensuring you have the rights necessary to upload and use such data within the Service. Our handling of data is described in our Privacy Policy.
5. Third-party services
The Service integrates with third-party platforms, including Google Business Profile and Square. Your use of those integrations is also subject to the respective providers’ terms and policies, including the Google Terms of Service. We are not responsible for third-party services or their availability.
6. Intellectual property
The Service, including its software, design, and trademarks, is owned by SP Hospitality Group and Crema Gourmet and is protected by applicable law. These Terms do not grant you any right to our trademarks or branding except as needed to use the Service.
7. Confidentiality
The Service and the information within it are confidential and intended for internal use. You agree not to disclose non-public information obtained through the Service except as authorized.
8. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.
9. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising from or related to your use of the Service.
10. Termination
We may suspend or terminate access to the Service at any time, including for violation of these Terms or when your authorization to use the Service ends.
11. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
12. Governing law
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules.
